One-Stop Claims Management

Because every business decision or interaction comes with legal consequence, Claims Management becomes a systematic project throughout the lifespan of a company’s commercial activities. A wise business decision or interaction always relies on the balance of commercial and legal consideration.

Claims Management is a practice of combination of law and facts. To provide legal opinion as per textbook is straightforward, it is more challenging to actually solve a problem. Apart from utilizing legal knowledge and experienced skill precisely, it requires identifying the problem correctly and sorting out facts properly. Such requirement inevitably calls for the excellent understanding and cooperation to/with a company’s daily operation (decision and interaction).

Since Claims Management has such tight connection with a company’s daily operation, the most efficient Claims Management service must simultaneously be so comprehensive that covers every aspects of a company’s commercial activities.

Our One-Stop Claims Management service is designed for the deep integration with a company’s daily operation. Because no two companies are alike, each of such proposal must be tailor-made.

Demurrage Recovery

This one-stop product is a typical example of a fusion of commercial and legal combination.

“Laytime and Demurrage” is such a complex issue that it can be written in another 600-page book apart from the Voyage Charter, especially when it comes with different charterparties and impacted by weather, strikes, machinery breakdown, congestion and etc.

We can assist the chartering desk to review their demurrage clause before fixture, as well as shoulder the burden of operation and legal desk in calculating and recovering demurrage. Subject to qualifying criteria, we can also provide access to the financing of demurrage owed under charterparties or commodity sales contracts to improve clients’ liquidity and cash flow.

Shipmanager Protection

This product is designed to support third party shipmanagers with legal advice services where:

  • The dispute may not involve an allegation of negligence, so would not necessarily fall under a shipmanager’s Professional Indemnity insurance.
  • The dispute may be between the shipowner and the shipmanager, meaning that disputes between joint assureds under the Defence entry are not covered.
  • The shipmanager may be in dispute with a third-party provider and there is no Defence entry for the vessel or the manager is not a joint assured on the Defence entry
  • The issue affecting the shipmanager does not flow from the vessel and is more of a commercial dispute with another party
